Judge Affirms Kentucky Students’ Right to Be Heard in Education Lawsuit

Kentucky Student Voice Team’s lawsuit advances after a Franklin County judge denies the state’s motion to dismiss and affirms students’ right to challenge education policy in court.

This morning we received a ruling from the Franklin County Circuit Court on our lawsuit, Kentucky Student Voice Team v. Commonwealth of Kentucky. Our Complaint argues that policymakers in Frankfort are in violation of providing Kentucky students their constitutional right to an adequate education. Judge Philip Shepherd denied the defendants’ motions to dismiss our litigation and affirmed that students unequivocally have standing to bring this litigation to trial. This is a resounding victory for Kentucky students, but it also marks the first step in a long judicial process.

Members of the Kentucky Student Voice Team and individual plaintiffs will be hosting a press conference on Monday, February 9 at 3:30 p.m. in front of the Franklin County Courthouse to outline our takeaways from the ruling and lay out our next steps as the case continues to work through Kentucky’s judicial system.
